The general principles and definitions as we have known them from the previous Privacy Code are unchanged; the radical change is found in the philosophy of the standard itself.<\/p>\n<p>The Regulations introduce a <strong>new principle of substantive accountability of the data owner<\/strong>. The purpose of the previous legislation was to certify a protection system capable of guarding data of a personal and\/or sensitive nature, minimizing the risks of destruction or loss, even accidental, and preventing access by unauthorized persons.<\/p>\n<p>This is a shift from a logic of compliance with the law to a logic of a true management system or Privacy model. The goal of the Privacy Management System is to be able to demonstrate and document the company&#8217;s commitment to protecting personal data. The<strong>methodological approach<\/strong> of the GDPR is <strong>risk-based<\/strong>, that is, such that appropriate measures are met based on specific risks.<\/p>\n<p>The European Regulation also changed the penalty system: penalties range from a minimum of 2 percent of turnover to a maximum of 4 percent of the company&#8217;s overall turnover.<\/p>\n<p>The European Regulation applies to <strong>all organizations established in the EU<\/strong> (even if processing takes place outside the EU), but also to organizations located outside the EU that offer goods or services to data subjects located in the EU.<\/p>\n<\/div><\/section>\n\n<\/div><\/div><\/main><!-- close content main element --><\/div><\/div><div id='av_section_2'  class='avia-section av-1fb7ow-1a626a18d9825724f176370df990c656 main_color avia-section-default avia-no-shadow  avia-builder-el-5  el_after_av_section  el_before_av_section  avia-bg-style-scroll container_wrap sidebar_right'  ><div class='container av-section-cont-open' ><div class='template-page content  av-content-small alpha units'><div class='post-entry post-entry-type-page post-entry-3341'><div class='entry-content-wrapper clearfix'>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-907rc-d6c023abaaccd8bc9acb893c546b8d8c\">\n#top .av-special-heading.av-907rc-d6c023abaaccd8bc9acb893c546b8d8c{\npadding-bottom:10px;\n}\nbody .av-special-heading.av-907rc-d6c023abaaccd8bc9acb893c546b8d8c .av-special-heading-tag .heading-char{\nfont-size:25px;\n}\n.av-special-heading.av-907rc-d6c023abaaccd8bc9acb893c546b8d8c .av-subheading{\nfont-size:15px;\n}\n<\/style>\n<div  class='av-special-heading av-907rc-d6c023abaaccd8bc9acb893c546b8d8c av-special-heading-h2  avia-builder-el-6  el_before_av_textblock  avia-builder-el-first '><h2 class='av-special-heading-tag '  itemprop=\"headline\"  >Implementation of the Privacy Management System<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div>\n<section  class='av_textblock_section av-177hdk-1051f0d48ee325a7e55e9930d0789e5c '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p style=\"text-align: left;\">The activity involves an <strong>initial analysis <\/strong>of Privacy risks for which internal resources responsible for or areas deemed sensitive for the purposes of the standard are involved.
